Know Your Rights: How Silva & Fontes Can Support You Amid Recent Immigration Changes

You are an important member of society, and you have legal rights.

If you are interested in scheduling an immigration consultation to discuss your possible options, we invite you to TEXT us at: 602-671-0748 and we will contact you to schedule.

WHAT CAN SILVA & FONTES DO FOR YOU?

  1. Conduct an initial screening of your case, to advise if there are any legal status applications you qualify for.
  2. Provide you with an Attorney Representation form (G28), that you can keep with you and provide it to any immigration agents you may encounter.
  3. Keep some of your important documents on file, in the event you are detained, we will have easy access to documents to be able to seek your release (if you qualify).
  4. We may handle your deportation case: If you agree with the relief we seek.

WHAT CAN YOU DO FOR YOURSELF?

The most important thing you can do for yourself and family is to KNOW YOUR RIGHTS AND USE THEM:

IF YOU ARE DETAINED OR TAKEN INTO CUSTODY:

  1. You have the right to speak to an attorney. Hand your signed G28 to the ICE officer and say you want to call the attorney
  2. You have the right to contact your consulate, for civil and legal advice.
  3. You can refuse to sign any/all paperwork until you have reviewed the documents and make sure that you understand the documents. Don’t sign anything you don’t understand.
  4. You have the right to request a phone call to family members.

IF ICE AGENTS APPEAR AT YOUR HOME:

  1. You do not have to open the door unless they have a valid search warrant signed by a judge. Ask the agent to slide the search warrant under the door or hold it up to a window so you can make sure it has your correct name and address on it and is signed by a judge. Otherwise, you do not have to open the door or let them inside.
  2. You can choose to speak to them through the door or step outside and close the door.
  3. You have the right to remain silent or refuse to answer any of their questions. If you choose to remain silent, say “I choose to remain silent” or “I will not answer questions” out loud.
